I. Basic Provisions

II. Sources and Categories of Personal Data Processed
1. The Controller processes personal data provided by you or personal data obtained by the Controller in connection with the fulfilment of your order.
2. The Controller processes your identification and contact details and data necessary for the performance of the contract.
III. Legal Basis and Purpose of Processing Personal Data
1. The legal basis for the processing of personal data is:
- performance of the contract between you and the Controller pursuant to Article 6(1)(b) GDPR,
- the Controller’s legitimate interest in direct marketing (in particular for sending commercial communications and newsletters) pursuant to Article 6(1)(f) GDPR,
- your consent to the processing for direct marketing purposes (in particular for sending commercial communications and newsletters) pursuant to Article 6(1)(a) GDPR in conjunction with Section 7(2) of Act No. 480/2004 Coll., on certain information society services, in cases where no goods or services have been ordered.
2. The purpose of processing personal data is:
- to process your order and to exercise the rights and obligations arising from the contractual relationship between you and the Controller; when placing an order, personal data necessary for the successful processing of the order (name, address, contact) are required. Providing personal data is a necessary requirement for concluding and performing the contract; without providing personal data, the contract cannot be concluded or fulfilled by the Controller,
- to send commercial communications and to carry out other marketing activities.
3. The Controller does not / does carry out automated individual decision-making within the meaning of Article 22 GDPR. You have given your explicit consent to such processing.
IV. Data Retention Period
1. The Controller retains personal data:
- for the period necessary to exercise the rights and obligations arising from the contractual relationship between you and the Controller and to assert claims arising from these contractual relationships (for 15 years after the end of the contractual relationship).
- for as long as the consent to the processing of personal data for marketing purposes is not withdrawn, but no longer than 3 years if the processing is based on consent.
2. After the retention period, the Controller will delete the personal data.
V. Recipients of Personal Data (Controller’s Subcontractors)
1. Recipients of personal data are entities that:
- are involved in the delivery of goods/services/payment processing based on the contract,
- provide e-shop operation services (Shoptet) and other services related to the operation of the e-shop,
- provide marketing services.
2. The Controller does not / does intend to transfer personal data to a third country (outside the EU) or an international organization. Recipients of personal data in third countries are providers of mailing services/cloud services.
VI. Your Rights
1. Under the conditions set out in the GDPR, you have the right to:
- access your personal data under Article 15 GDPR,
- rectify personal data under Article 16 GDPR or restrict processing under Article 18 GDPR,
- erase personal data under Article 17 GDPR,
- object to processing under Article 21 GDPR,
- data portability under Article 20 GDPR,
- withdraw consent to processing in writing or electronically to the address or email of the Controller specified in Article III of these terms.
2. You also have the right to lodge a complaint with the Data Protection Authority if you believe that your right to personal data protection has been violated.
VII. Conditions for Securing Personal Data
1. The Controller declares that it has taken all appropriate technical and organizational measures to secure personal data.

VIII. Final Provisions
1. By submitting an order via the online order form, you confirm that you have read and fully accept these personal data protection terms.
2. You agree to these terms by ticking the consent checkbox in the online form. By doing so, you confirm that you have read and fully accept the personal data protection terms.
3. The Controller is entitled to change these terms. The new version of the data protection terms will be published on its website and will also be sent to your email address provided to the Controller.
